Privacy policy

1. GENERAL PROVISIONS

1.1. This Privacy Policy (hereinafter – the Policy) regulates the procedure for processing information and personal data of the User collected through the Website and the Service.

1.2. This Privacy Policy is an integral part of the Public Offer. 

1.3. The terms in this privacy policy are used in accordance with the Public Offer.

1.4. The information and personal data of the Users are processed by RSM Limited Liability Company (legal entity identification code 43589510, legal address: 18005, Cherkasy region, Cherkasy, 22 Tolstoy Street, apartment 3), which is registered and operates in accordance with the laws of Ukraine (hereinafter referred to as the Contractor). The Contractor is the owner of the information and personal data of the Users.

1.5. By using the Website and/or the Service, the User automatically agrees to the terms of this Privacy Policy. 

2. INFORMATION PROCESSED BY THE CONTRACTOR

2.1. When interacting with the User, the Contractor processes the following information:

2.1.1. Personal data: 

  • last name, first name, patronymic; name of the company or legal entity; place of residence and registration, e-mail address, contact phone number, other contact information; IP addresses, other communication data of the User; logins, passwords; bank details; identification and tax number; date and year of birth; age, gender, social status.

2.1.2. Commercial information:

  • information and data of a professional, industrial, business, organizational, commercial and other nature, including: information about goods, their quantity and types, prices for goods; 
  • information contained in databases, reports, analytical materials, statements, charts, graphs, specifications, tables; information related to agreements, contracts and other transactions, pricing of goods and services; information containing commercial and banking secrets; business plans and business development strategies; 
  • photographic images of goods, employees, partners, office space, trademarks, etc;
  • information on suppliers and buyers; information on production equipment; information on methods of purchasing and selling goods; information on types of activities; information on equipment used in the course of activities, on the quantity and value of inventory; information on balance sheets and bank account balances; information on income; information on the procurement, sales and investment plan; 
  • information on the methods and means of management; information on the internal structure of the company; information on the efficiency of the main activity, production capabilities, development plans, expansion plans, investment, procurement and sales plans and other commercial plans; information on management methods, its planning and control systems;
  • any other data that may constitute commercial information.

3. USE OF INFORMATION

3.1. By disclosing the information, the User gives the Contractor his/her consent to the processing of the User’s information (including: collection, storage, systematization, modification, deletion, use, distribution, depersonalization, blocking).

3.2. The User’s personal information may be processed by the Contractor for the following purposes:

3.2.1. To provide the User with the Services, including to provide access to the Service.

3.2.2. To ensure the security and functioning of the Website and the Service; to administer the Website and the Service, including internal operations, including troubleshooting, data analysis, testing and surveys, etc.

3.2.3. To inform the User about new types of Services, changes in the cost of the Services, news, promotions, advertising campaigns, informational messages, etc.

3.2.4. For marketing activities, advertising, including through Google Ads and similar resources; to analyze the behavior and preferences of the User.

3.2.5. To provide feedback and communicate with the User.

3.2.6. To interact with payment services.

3.2.7. To respond to requests from law enforcement and other government agencies.

3.3. The User’s commercial information is processed by the Contractor in order to enable the User to use the functionality of the Service, as well as to process statistical data without disclosing the content of commercial information.

3.4. The Contractor has the right to transfer the User’s information to other entities, namely:

3.4.1. Employees, contractors, legal and tax consultants; entities providing accounting, marketing, advertising and IT services, etc. for the proper provision of services to the User.

3.4.2. To courts, law enforcement and government agencies – in case of fulfillment of any legal obligations, including in connection with a court decision.

3.4.3. To its successors – in the event of acquisition or merger, financing, corporate reorganization, establishment of a joint venture, sale of the Contractor’s assets.

3.4.4. Payment and banking systems – for the User to properly pay for the Contractor’s Services. 

3.5. The User is informed and agrees that telephone conversations (including conversations via messengers, etc.) with the Contractor or his representative may be recorded in order to control the quality of work of the Contractor and/or his representative(s).

3.6. The Contractor shall have the right to send advertising messages to the User, promote the Contractor’s services, information materials, promotions, drawings, etc., including by phone, e-mail, SMS, messages through messengers, etc. The User has the right to refuse such mailing at any time by sending a notice to the Contractor. The withdrawal of the User’s consent to receive the newsletter does not lead to the Contractor’s refusal to provide services to the User.

3.7. The Contractor shall store the User’s information for the period necessary to achieve the purposes for which the information was collected. To determine the appropriate storage period, the Contractor shall take into account the amount, nature and sensitivity of personal data, the potential risk of harm from unauthorized use or disclosure of personal data, the purpose for which the Contractor processes personal data.

3.8. For the purpose of high-quality and reliable data storage, Users’ information may be stored on various local servers, including foreign servers, servers of the Contractor’s subcontractors. 

3.9. The Contractor makes every effort to preserve personal data and prevent its loss.

3.10. The Contractor shall not be liable for the loss of personal data in the event of a hacker attack, software hacking, illegal actions of third parties, illegal actions of the User and actions of the User that violate the terms of the Privacy Policy or the Public Offer;

3.11. As a result of a failure, technical malfunction, actions of third parties, including, but not limited to, a virus or hacker attack, the User’s data may become available to third parties. The User is aware of this and undertakes not to make any claims to the Contractor for compensation for losses (damage) arising in this regard.

3.12. When processing the User’s personal data, the Contractor shall be guided by and comply with the requirements of the current legislation of Ukraine on personal data protection.

3.13. By using the Website or the Service, the User authorizes the Contractor to indicate the User as its client in advertising, marketing campaigns, etc.

4. COOKIES

4.1. The Website uses cookies. For the convenient operation of the Website, it collects cookies – small text files that store information about the User’s interaction with the Website functions and individual interface settings. The server automatically accesses them during each visit of the User. They are generated by a browser and stored directly on a computer, tablet or phone. Thanks to them, for example, the User does not have to repeat the authorization process during the next visit.

4.2. If the consent to the use of cookies is not provided or the User withdraws his/her consent, the use of the Website for the User may be partially or completely disabled.

4.3. The Contractor uses persistent and session cookies. 

4.4. Persistent files are updated after the User’s visit. They may include “third-party cookies” placed by third-party sites. To optimize the service, improve the quality of services, as well as for commercial purposes, the right to collect and process information contained in cookies may be granted to analysts, optimizers and advertising agencies. The data they collect is subject to disclosure in accordance with their privacy policy statements.

4.5. Session cookies are deleted automatically when you end your session and exit the browser.

4.6. Cookies are divided into four types according to their purpose:

  • Required;
  • Functional;
  • Analytical;
  • Targets.

4.7. Mandatory cookies are used to speed up the work with the Website, so they collect basic information about the User’s interaction with the resource. For example, data to fill in the authorization field.  

4.8. Functional cookies are designed to optimize your workflow: they store information about your language, location, and the selection of specific settings.

4.9. Analytical cookies process information about the User’s behavior: how many times the User has visited the Website, how long the session lasts, how many pages are opened during the session. Such information is needed solely to improve the interface in accordance with the User’s preferences, to make access to popular and important pages as simple and fast as possible.

4.10. Targeted cookies collect information that helps to customize relevant advertising and evaluate the effectiveness of existing campaigns. Thanks to them, the User sees only useful ad units on the pages. They can be transferred to advertisers to improve their service.

4.11. In the User’s browser settings, you can disable cookies and delete saved text documents. If the User does so, some functions of the Website may become unavailable to him/her.  

5. WITHDRAWAL OF CONSENT TO THE PROCESSING OF INFORMATION

5.1. Withdrawal of consent to the processing of information (in whole or in part) may be carried out by the User by sending a notice to the Contractor’s address specified in the details of this Policy. 

5.2. At the same time, the User agrees that such a letter of withdrawal may entail negative consequences for him/her, namely: the Contractor’s refusal to provide the Services (including the termination of access to the Service) due to the impossibility of their performance without the specified data. In this case, the funds paid by the User shall not be refunded by the Contractor.  

6. MAKING CHANGES TO THE PRIVACY POLICY

6.1. This Privacy Policy may be changed by the Contractor unilaterally, without notice to the User. The new version of the Privacy Policy comes into force from the moment it is posted on the Website.

6.2. By using the Website or the Service, the User confirms acceptance of the new terms of the Privacy Policy in the version effective at the time of the User’s use of the Website or the Service.
